Conservatives condemn, in the strongest possible terms, the politicization of the Biden Department of Justice (DOJ) and Federal Bureau of Investigation (FBI) in operation “Arctic Frost.” The ongoing revelations make clear that the so-called investigations carried out under Arctic Frost were not law enforcement – they were a meticulous, systematic attempt to use the power of the federal government to harass and dismantle the entire infrastructure of the political right.
The Extent and Scope of Arctic Frost: A Systematic Assault on Conservatives
Unveiled through de-classifications from FBI Director Kash Patel and FBI whistleblower documents provided to Senate Judiciary Chairman Chuck Grassley and Permanent Subcommittee on Investigations Chairman Senator Ron Johnson, Arctic Frost is the Biden FBI’s code name for an expansive probe into alleged efforts to challenge the 2020 election results – legally protected activities that the Biden FBI decided were “election interference.”
Far from a legitimate investigation, Arctic Frost served as a vehicle for partisans within the government to weaponize federal authority against, as Chairman Grassley noted, the “entire Republican political apparatus.” Culpability for this brazen politicization started at the top: Arctic Frost was approved by Attorney General Merrick Garland, Deputy Attorney General Lisa Monaco, and FBI Director Christopher Wray. They personally signed off on an operation whose reach was unprecedented and breathtaking in its breadth and audacity:
- Targeting Elected Officials: At least eight Republican U.S. Senators were subjected to surveillance, including GOP senators Tommy Tuberville, Ron Johnson, Bill Hagerty, Josh Hawley, Marsha Blackburn, Ted Cruz, among others. This violated the federal law requiring direct notification to members of Congress before such subpoenas are issued, potentially constituting unlawful overreach by U.S. District Judge James Boasberg, who authorized the subpoenas for the phone records and signed off on the gag orders preventing the Members of Congress from being notified.
- Mass Subpoenas and Investigations: Special Counsel Jack Smith issued 197 subpoenas, ensnaring over 160 Republicans – from lawmakers to everyday activists – in a dragnet of intimidation. Reports indicate the total toll exceeded 430 conservative individuals and organizations, including Citizens United and its affiliated Foundation, Turning Point USA, the Conservative Partnership Institute, America First Legal, which did not even exist on January 6, 2021, and Center for Renewing America, which hadn’t even begun operations by that date. Also swept up were countless grassroots leaders who dared question election irregularities or support constitutional challenges.
- Diversion of Resources and Broader Harassment: Thousands of FBI agents were diverted from critical priorities, such as pursuing child predators, to hunt conservatives for their political speech. This included potentially unconstitutional infringements on First Amendment rights, with subpoenas aimed at silencing dissent rather than uncovering crimes. The operation extended to wiretaps, financial scrutiny, and cyber investigations, creating an “enemies list” that chilled free expression across the nation.
The point of Arctic Frost was harassment. Despite a staggering number of subpoenas issued over two years, Jack Smith was never able to find a crime – because the process was intended to be the punishment. Arctic Frost was meant to punish, bankrupt, smear, and potentially to jail. It used the authority of the federal government to tyrannize the organized political right.
The actions taken as part of Arctic Frost represent a grotesque betrayal of the oaths taken by public servants to protect, not persecute, the American people. This operation embodied the very authoritarianism conservatives have long warned against: a federal leviathan unbound by law, targeting citizens for their ideology rather than their actions. As Senator Ted Cruz noted recently, “Arctic Frost is Joe Biden’s Watergate. And, in fact, in terms of abuse of government power, it makes Watergate pale in comparison.”
Arctic Frost grossly and directly undermined the American system of justice. The only way forward can be a level of accountability which matches the scale of the destruction. Jack Smith, Judge Boasberg, and the complicit Biden officials, including those at the FBI, must face immediate accountability – including termination, disbarment, impeachment, and where appropriate, prosecution for their roles in this vast conspiracy against liberty.
